What Happens If a Case Doesn't Settle at Mediation?

Posted by Scott Brooks | Jun 25, 2026 | 0 Comments

One of the most common questions people ask before mediation is, "What happens if we don't reach an agreement?"

The short answer is simple: if a case does not settle at mediation, the parties still have options, and the case continues through the legal process.

Mediation Is an Opportunity, Not a Requirement to Settle

Mediation is designed to help parties explore potential resolutions in a confidential and structured environment. While many disputes are successfully resolved through mediation, no party is required to accept an agreement they believe is unfair or not in their best interests.

If an agreement cannot be reached, mediation simply concludes without a settlement.

The Case Continues

When a mediation does not result in a settlement, the case typically proceeds as it would have before mediation. Depending on the type of dispute, this may include:

  • Additional negotiations between the parties
  • Further discovery and information gathering
  • Pretrial hearings
  • Arbitration (if required by contract)
  • Trial before a judge or jury

Mediation does not prevent a party from pursuing their legal rights if a resolution is not achieved.

Not Settling Doesn't Mean Mediation Failed

Many people view mediation as successful only if an agreement is signed that day. However, that is not always the case.

Even when a case does not settle immediately, mediation often helps parties:

  • Better understand the strengths and weaknesses of their positions
  • Identify key issues in dispute
  • Narrow the gap between settlement offers
  • Improve communication
  • Establish a framework for future negotiations

In many cases, disputes settle days or weeks after mediation because the discussions helped move the parties closer to resolution.

Partial Agreements Can Still Be Valuable

Sometimes parties resolve some issues but not others. These partial agreements can reduce the scope of the dispute and make future negotiations or litigation more efficient.

Even a limited agreement can save time, expense, and uncertainty moving forward.

Every Mediation Provides Value

Whether a case settles during mediation or continues through the legal process, mediation gives parties an opportunity to explore solutions, evaluate risks, and make informed decisions about their next steps.

At Brooks Legal, we understand that every dispute is unique. Our goal is to provide a professional and productive environment where parties can work toward resolution while maintaining control over the outcome whenever possible.
